Criminal Division

The criminal division is responsible for the prosecution of felony crimes committed by adults in Mohave County. The division consists of 22 attorneys, 2 investigators and 24 support staff. Typical cases handled by the division include murder, assault, drug sales, burglary, theft, kidnapping, rape and armed robbery. But prosecution doesn’t tell the full story about the Criminal Division. It also has established diversion programs to help rehabilitate people and a Bad Check Program to help merchants and individuals with bad checks.

The responsibilities of the prosecutors include:

  • Consulting with police and other law enforcement agencies about legal questions that arise during the course of investigations;
  • Reviewing all criminal cases presented by law enforcement agencies for possible charging;
  • Preparing and filing criminal charges in district court, when the evidence warrants prosecution;
  • Negotiating settlements in cases, when appropriate; and
  • Trying cases in front of judges and juries.
  • Consulting with police and other law enforcement agencies about legal questions that arise during the course of investigations;

Prosecutors work closely with the Victim/Witness Division who maintain contact with victims and witnesses and provide information about their roles and rights in the legal process.

The Criminal Division is comprised of the following:

The County Attorney is responsible for prosecuting all felonies that occur throughout Mohave County, all misdemeanors that occur in the unincorporated areas of the county.  The Office receives referrals from law enforcement agencies throughout the county who conduct the investigations and refer the cases to this office for prosecution.  The Criminal Division consists of prosecutors, investigators and support staff to assist in successful prosecutions.

The County Attorney presents cases to the grand jury one day per week, a process that starts the felony criminal case.  Deputy County Attorneys appear in the Superior and Justice courts throughout the county.

The misdemeanor division handles cases that are legally classified as lower than felonies. These crimes are punishable by incarceration in the County jail rather than the state corrections facility and/or fine. These offenses include DUI, assault, trespass, shoplifting, issuing a bad check, and disorderly conduct.

Narcotics and drug prosecutions are a priority in Mohave County. This special unit works closely with the M.A.G.N.E.T. Division (Mohave Area General Narcotics Enforcement Team) in the prosecution of dealers and the seizure of assets obtained by the dealers from the sales of drugs.

The Juvenile Division reviews referrals from Juvenile Probation on crimes committed by juveniles. Decisions are made based upon severity of crime, recidivism and other factors as to whether to file a petition or defer prosecution or not file on the juvenile.

The program provides successful prosecution of juvenile offenders in making recommendations to Juvenile Court regarding consequences relative to the nature of the crime committed by the minor. Recommendations include filing petitions and progression through the formal Juvenile Court System, deferred prosecution, and/or community service.
